These Terms of Use ("Terms") govern your access to and use of the Adapina mobile application and any related services (collectively, "Adapina" or the "Service"). By downloading, installing, or using Adapina, you agree to these Terms. If you do not agree, do not use the Service.
Adapina is a study aid designed to help candidates prepare for the National Registry of Emergency Medical Technicians (NREMT) EMT-Basic cognitive exam. The Service provides practice items, a computerized adaptive test (CAT) simulator, a readiness verdict drawn from the user's answer pattern, and domain-level accuracy summaries. Adapina is an independent study tool. It is not affiliated with, endorsed by, or sponsored by the NREMT.
Adapina is a study aid, not a substitute for clinical training, classroom instruction, or medical advice. Nothing in the Service constitutes a diagnosis, treatment plan, prescription, or professional medical recommendation. Always verify clinical content against current institutional protocols, your EMS instructor, your medical director, and current jurisdictional scope of practice. The Readiness Verdict is a statistical projection based on your in-app answer pattern. It is not a guarantee, prediction, or warranty of how you will perform on the actual NREMT examination, or in any patient-care setting.
You must be at least 17 years old to use Adapina. By using the Service you represent that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using Adapina on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Adapina offers paid subscriptions, currently labeled "Adapina Pro Monthly" and "Adapina Pro 3-Month." Subscription names, prices, included features, and trial terms are displayed inside the app on the paywall screen at the point of purchase, and are the controlling description of what you are buying.
Auto-renewal. Subscriptions are auto-renewing. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription will automatically renew for the same term length unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Free trial. If a free trial is offered with a subscription, the trial converts into a paid subscription at the end of the trial period unless you cancel before the trial ends. You can cancel at any time during the trial without charge.
Managing and canceling. You can manage and cancel your subscription at any time by going to your Apple ID Subscriptions settings on your device. Removing the Adapina app does not, by itself, cancel an active subscription. Cancellation takes effect at the end of the current paid period; access continues until that period ends.
Price changes. Subscription prices may change. Where required, you will be notified of a price change before it takes effect, and any change to an existing subscription will take effect at the next renewal after notice. Continued use of the Service after the change takes effect constitutes acceptance of the new price.
All purchases of Adapina subscriptions are processed by Apple through the App Store. Refund requests are handled by Apple under Apple's standard refund policies; Adapina does not directly process refunds for App Store purchases. To request a refund, use Apple's "Report a Problem" page at reportaproblem.apple.com or contact Apple Support. If you have a billing concern you believe Adapina can help with, contact us at support@adapina.com and we will do what we can within Apple's framework.
By using Adapina you agree that you will not, and will not assist any third party to:
You are responsible for keeping your device, your Apple ID, and any related credentials secure. Adapina does not maintain user accounts and does not have a way to recover progress lost from device loss, reset, or deletion.
Adapina, including the app, the brand, the question bank, the rationales, the CAT Simulator scoring engine, the Readiness Verdict logic, the visual design, and all related materials, is owned by Adapina's operator and is protected by copyright, trademark, and other intellectual-property laws. Subject to your compliance with these Terms, Adapina grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Adapina on devices you own or control, solely for your own non-commercial study purposes. No other rights are granted. "NREMT" and any other third-party marks referenced in the Service are the property of their respective owners and are used only for descriptive purposes.
Adapina's collection and handling of data is described in the Privacy Policy at adapina.com/privacy. The Privacy Policy is incorporated into these Terms by reference. By using Adapina you acknowledge that you have read and understood the Privacy Policy.
Adapina uses Apple's App Store for distribution and billing, and RevenueCat for subscription analytics and entitlement verification. Your use of Apple's services is governed by Apple's terms and policies. RevenueCat's handling of subscription data is described in its privacy policy at revenuecat.com/privacy. Adapina is not responsible for third-party services beyond the scope of how Adapina itself uses them, which is described in the Privacy Policy.
ADAPINA IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADAPINA DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE. ADAPINA DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE READINESS VERDICT WILL ACCURATELY PROJECT YOUR PERFORMANCE ON THE NREMT EXAMINATION OR IN ANY CLINICAL SETTING.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL ADAPINA, ITS OPERATOR, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADAPINA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ADAPINA'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID ADAPINA FOR THE SERVICE DURING THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) FIFTY UNITED STATES DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES; IN THOSE JURISDICTIONS, THE FOREGOING LIMITATIONS WILL APPLY ONLY TO THE EXTENT PERMITTED.
You agree to defend, indemnify, and hold harmless Adapina and its operator from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.
You may stop using Adapina at any time by deleting the app from your device. Adapina may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected violation of these Terms. Termination does not by itself entitle you to a refund of any subscription fees already paid. Sections of these Terms that by their nature should survive termination, including ownership, disclaimers, limitations of liability, indemnification, and governing law, will survive.
Adapina may update, modify, or discontinue features of the Service at any time. Adapina may also update these Terms. When material changes are made, the "Last updated" date at the top of this page will be revised, and material changes will be surfaced inside the app on next launch. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-laws principles. You and Adapina agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts. To the extent any dispute relates to a purchase made through the App Store, Apple's dispute-resolution terms also apply. Nothing in this section limits any non-waivable consumer rights you may have under the laws of your jurisdiction of residence.
If you obtained Adapina through the Apple App Store, the following also applies. These Terms are between you and Adapina, not Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. In the event of any failure of the Service to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the Service; to the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.
These Terms, together with the Privacy Policy, are the entire agreement between you and Adapina regarding the Service and supersede any prior agreements on the same subject. If any provision of these Terms is held to be unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect. Adapina's failure to enforce any right or provision is not a waiver of that right or provision.
